On May 24, 1996, Petitioner was charged by Information in Potter County, Texas with the
first-degree felony offense of murder in violation of section 19.02(b)(1) of the Texas Penal Code. (ECF 11-4 at 5, 10). Specifically, the Information alleged that on or about August 21, 1994, Petitioner “did then and there knowingly and intentionally cause the death of an individual, namely CHARLES SMITH, by shooting CHARLES SMITH with a deadly weapon, to-wit: a firearm.”
(ECF 11-4 at 5). To this charge, Petitioner pleaded guilty. (ECF 11-4 at 6). The trial court then sentenced Petitioner to 40 years imprisonment in the Texas Department of Criminal Justice (“TDCJ”), Correctional Institutional Division and entered judgment accordingly. (
