AMARILLO, TX - Jimmie Urbano Lucero will move off death row and start serving a life sentence,

52-year-old Jimmie Lucero was sentenced to life in prison Tuesday morning. He won't be eligible for parole for 40 years.

Back in 2005,  Lucero was convicted of killing a family of three in their home on Sixth street. He was sentenced death, however, just a few weeks ago,  the Texas Court of Criminal Appeals threw out the death penalty, saying Lucero was not effectively represented by his trial lawyers.

DA Randall Sims tells us, Lucero was not re-tried because he does not want to put the families through another trial. That includes a victim who was critically injured during Lucero's attack.

"They all did quite well, they were willing to participate at that time. Now its been additional years, they have all moved on and Guadelupe was just devastated about getting back up there and doing that again." Said Sims.

According to Sims, this decision is final.

"On a death penalty case, its automatic right to appeal, whether a defendant wants to appeal or not.  On a non-death penalty case, they can waive the right to appeal.  He's done so on 2 documents and said he understood that in court." Sims tells NewsChannel 10.^[1]
